Estimating Terms & Conditions

Estimating Terms and Conditions

BuildScope360 L.L.C. agrees to produce a digital "estimate" document with the work description set forth in the Invoice sent via email. The quantities, numbers, scope, or any other information contained in the estimate document will have been compiled to the best of our knowledge. By utilizing or deriving any of the information contained in the final "estimate" document described above, you accept the information and quantities as accurate and waive any rights to any claims for errors in information. It is the customer's responsibility to provide accurate drawings and scope of work. If inaccuracies or omissions in the provided information are discovered after the estimate is prepared, the customer is responsible for any resulting changes or discrepancies.

BuildScope360 L.L.C. does not warranty any of the information contained in the "estimate" document, and all estimates are non-binding. The estimates are compiled using the National Construction Estimator by Craftsman Book Company for local labor and material pricing, and BuildScope360 L.L.C. is not liable for any variations between estimated database costs and actual final pricing. By hiring BuildScope360 L.L.C. to produce the estimate, you acknowledge that this estimate is strictly a guideline for informational purposes only. Our pricing and quantities are not professional recommendations and should be used as a resource to assist in pricing. Labor and material costs can vary by region, vendor, supplier, contractor, and installer and are compiled based on a periodically updated construction cost database, which is subject to change without notice. Manually adjusted labor rates will be based on the client's approved hourly rate.

Delivery & Timeline

The estimated delivery of the "estimate" is typically within 9 business days after the date of payment unless otherwise noted. This delivery timeline is an estimate and is not guaranteed. BuildScope360 L.L.C. is not responsible for delays within this window, and delivery is not guaranteed by a customer's bid or required date unless an expedite fee or guaranteed-by fee is included in the invoice. Business days are defined as Monday through Friday, excluding all holidays. Should any delays occur, BuildScope360 L.L.C. will communicate with the client regarding the revised delivery schedule.

Cancellation & Refund Policy

In the event that an estimate is canceled after payment but before delivery, BuildScope360 L.L.C. will review the request and determine the appropriate amount of any potential refund. Refund calculations will take into account all costs incurred, including labor, transaction fees, and other expenses. The minimum cancellation fee is 25%, even if no work has commenced. However, once payment is made, BuildScope360 L.L.C. reserves the right to refuse refunds and may issue a credit to be used for future estimates. Clients must request cancellation within [specify timeline] to be eligible for any refund or credit.

Standard Estimate & Revisions

A standard estimate consists of a spreadsheet detailing costs for labor, materials, subcontractor markup, contingency, supervision, equipment, and construction costs. If a material list is provided, it includes only basic preliminary quantities and may not include accessories, connectors, screws, or other miscellaneous items required for installation. Any revisions to the estimate that differ from the original scope or delivery are considered additional work and may incur extra fees. Revisions are not considered part of the original product or service provided and are not required unless additional fees are agreed upon and collected.

Confidentiality & Use of Information

BuildScope360 L.L.C. reserves the right to use any media in any format, including but not limited to company name, project name, individual name, testimonial, estimate, documentation, PDFs, drawings, images, and client logos, for marketing purposes, unless a written agreement in the form of a Non-Disclosure Agreement (NDA) is provided by either BuildScope360 L.L.C. or the "client." If any information is sensitive or preferred to remain confidential, the client must notify BuildScope360 L.L.C. in writing, so a proper NDA can be drafted and signed by both parties.

Dispute Resolution & Governing Law

In the event of any dispute arising from these terms and conditions, the parties agree to first attempt resolution through mediation. Should mediation be unsuccessful, any further legal action will be subject to the jurisdiction and laws of [State].
